Terms of Service

The Service is provided by Marcin Szlęk, trading as msbytes Marcin Szlęk, Raciborsko 350, 32-020 Raciborsko, Poland, tax ID (NIP): 867-187-72-43, email: [email protected] (“we”, “us”).

By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.

MushTrack is a tool for mushers and dog sport athletes: kennel and dog records, recording and analysing runs, teams and formations, health and vaccination records, and — in the Pro plan — advanced statistics and importing activities from connected services. The app is available for iOS and Android, and the panel at mushtrack.app.

You must provide accurate information when creating an account and keep your sign-in details confidential. You are responsible for activity under your account. You must be at least 16 years old to use the Service.

MushTrack offers a free plan and a paid Pro subscription. Pro is purchased through the App Store or Google Play and is subject to their payment, renewal and refund terms. You manage and cancel the subscription in the relevant store. We do not process payments directly. When a subscription ends, Pro features stop working; your data remains in the account.

Pro users can link Garmin Connect to import activities. The connection depends on that service and its terms, which also apply to you. We are not responsible for its availability, for changes to its interfaces, or for the accuracy of the data it provides, and we may change or end the connection if Garmin changes or withdraws access. You can disconnect at any time. Garmin is a trademark of Garmin Ltd. or its subsidiaries; MushTrack is not affiliated with or endorsed by Garmin.

If you share content with other users (profile, runs, photos, comments), you confirm that you have the right to do so, and you grant us a non-exclusive, free licence to store and display it to the audience you selected, for as long as it is shared. Content must not be unlawful, offensive, misleading, infringe others’ rights or contain other people’s personal data without their consent. We may hide or remove content that breaks these rules and, in serious or repeated cases, suspend the account. You can report content to [email protected].

You agree to use the Service lawfully and in line with these Terms. You are responsible for the data you enter. The Service supports training records; it does not replace veterinary advice or your own judgement of conditions and your dogs’ well-being.

You may not: break the law using the Service; attempt unauthorised access to the Service or its infrastructure; reverse-engineer, decompile or disassemble the app, except where the law allows it; extract data with automated tools; harass other users; or resell or sublicense access to the Service.

The Service, its design and software belong to us and are protected by law. Your data (dog records, runs, photos) remains yours, and you can export or delete it.

We do our best to keep the Service available and correct, but provide it “as is”, without a guarantee of uninterrupted or error-free operation. GPS measurements and statistics may be inaccurate. Mandatory consumer rights are not affected.

To the extent permitted by law, we are not liable for indirect or consequential damages or lost data resulting from use of the Service. This does not limit liability for intentional damage or where the law does not allow it, in particular towards consumers.

You can submit complaints about the Service to [email protected]. We will respond within 14 days. Complaints about payments and refunds are handled by the App Store or Google Play. Consumers may also use out-of-court dispute resolution, for example through their local consumer ombudsman.

You can delete your account at any time in the app or the panel. We may suspend or close an account that seriously or repeatedly breaks these Terms, after a warning where possible.

We may change these Terms for important reasons, such as changes to the Service or the law. We will inform you at least 14 days in advance in the app or by email. If you do not accept the changes, you can delete your account before they take effect.

These Terms are governed by Polish law. This does not deprive consumers of the protection of mandatory laws of their country of residence. Disputes will be settled by the competent common court.
